Stopping Repossession and Creditor Lawsuits

Bankruptcy is one of the few legal tools that can halt collection activity almost immediately. When you file, the automatic stay generally stops vehicle repossessions, creditor lawsuits, wage garnishments, bank levies, and harassing collection calls. In Chapter 13, you can catch up on a car loan through your repayment plan, and in some cases reduce the balance on an older vehicle loan to its current value. In Chapter 7, you may keep your vehicle by staying current or redeem it for its value. ROC Law identifies the right approach based on your income and assets, then files promptly to protect your property. The firm also handles divorce, child custody, and support, criminal and DWI defense, and wills, trusts, and powers of attorney.

Frequently Asked Legal Questions

Can filing bankruptcy stop my car from being repossessed?

Filing bankruptcy triggers the automatic stay, which generally stops a pending repossession. Chapter 13 can let you catch up on missed car payments through your plan, and Chapter 7 may allow you to keep the vehicle if you resume payments and reaffirm the loan. If the car has already been taken, quick action may help you recover it.

Is a handwritten will legally valid in Missouri?

Missouri does not recognize handwritten wills that are not properly witnessed. A valid will must be in writing, signed by you, and signed by two witnesses who watch you sign. A self-proving affidavit with a notary makes probate easier. Because errors can invalidate a will, having an attorney prepare and supervise signing is the safest approach.

Can an old criminal conviction be expunged in Missouri?

Missouri expanded expungement eligibility in recent years, allowing many misdemeanors and some felonies to be closed after a waiting period, provided you meet certain conditions. Some offenses, including certain violent and sex offenses, remain ineligible. An attorney can review your record, confirm eligibility, and file the petition in the proper circuit court.
