Wills, Trusts, and Estate Planning Services

A thoughtful estate plan protects your family from confusion and expense at an already difficult time. ROC Law prepares wills, revocable living trusts, durable financial powers of attorney, health care directives, and beneficiary deeds tailored to your property and family. We explain how probate works in Missouri, which assets pass outside probate, and how to name guardians for minor children or plan for a family member with special circumstances. Estate planning is also a natural follow-up after major life changes, including divorce, remarriage, retirement, or the birth of a grandchild. Frequently Asked Legal Questions

Which debts cannot be eliminated through bankruptcy in Missouri?

Some debts generally survive bankruptcy, including child support, spousal maintenance, most recent tax debts, criminal fines, and debts from injuries caused by drunk driving. Student loans are difficult to discharge and require a separate showing of undue hardship. Credit cards, medical bills, and personal loans are typically dischargeable. An attorney can review each debt to set realistic expectations.

How is child support calculated by Missouri courts?

Missouri uses a formula known as Form 14, which considers both parents' gross incomes, the number of children, child care and health insurance costs, and the amount of overnight parenting time. The result is presumed correct, though a judge can deviate if it would be unjust or inappropriate. Support can be modified later when circumstances change substantially.

What happens to my property if I die without a will in Missouri?

Without a will, Missouri intestacy laws decide who inherits. Typically, a surviving spouse and children share the estate according to a fixed formula, and if there is no spouse or children, property passes to parents, siblings, or more distant relatives. The court also appoints the administrator. A will lets you make those decisions yourself.
